This simple fact sheet helps tenants understand their rights and responsibilities when entering into a retail lease.

It includes an easy to read checklist to guide you through what you need to understand and what you should look out for.

A landlord or person acting on behalf of a landlord must provide this fact sheet and a copy of the proposed lease to a person as soon as they enter into lease negotiations with that person. Failure to do so is an offence under section 15 of the Retail Leases Act 2003 and may result in fines of more than $8,000.

They must also provide a copy of the Disclosure Statement at least 7 days before entering into a retail lease – as found in the Retail Leases Regulations 2013.
