We work with you — and the party you have a dispute with — to resolve the issue through a process of information services and mediation.

Our assistance is neutral, which means we don’t take sides. Our services are designed to provide a framework to successfully resolve a commercial dispute between a contractor and their hirer — and vice versa.

What we do

Resolving disputes between owner drivers, forestry contractors, haulage contractors and hirers is a key function of the VSBC.

Disputes between contractors and hirers must come to the VSBC for mediation before they can be referred to the Victorian Civil and Administrative Tribunal (VCAT).

Among other things, the Owner Drivers and Forestry Contractors Act 2005 (the Act) provides basic protection for owner drivers and forestry contractors in the transport industry. The VSBC can help you understand your right and obligations under the Act.

How we help

Some of the common disputes the VSBC can assist in the resolution of include:

  • termination notices — usually relating to monies owing.
  • contract disputes — usually relating to terms and conditions, and written contracts.
  • alleged breaches of the Act.

The VSBC can also issue a certificate waiving the minimum notice period for a contract to be terminated.

Mediation with the VSBC is $95 per party. There is no cost for preliminary assistance that occurs over the phone or on email.


The Owner Drivers and Forestry Contractors Act 2005 was developed to regulate and establish mandatory requirements in regards to a code of practice.

Under the Act, the VSBC has an alternative dispute resolution function and can issue certificates for owner drivers to waive their right to a minimum period of notice of termination.

The Act also sets out requirements to assist contractors to improve their business skills and better understand their cost structures and their contracts.
