VSBC Mediation Panel

The VSBC has statutory dispute resolution functions under the Small Business Commission Act 2017, the Retail Leases Act 2003, the Owner Drivers and Forestry Contractors Act 2005, the Farm Debt Mediation Act 2011 and the Transport (Compliance and Miscellaneous) Act 1983.

On 1 July 2017, the former Office of the Victorian Small Business Commissioner became the Victorian Small Business Commission with a broader range of functions.

As part of these changes, we are creating a formal VSBC Mediation Panel to establish a diverse group of experienced, commercial dispute mediation professionals to continue offering Victorian small businesses a low cost and highly effective alternative dispute resolution service.

VSBC Mediation Panel

VSBC Mediation Panel Members will be appointed to the panel for a duration of two years. At completion of that period, the application process will be reopened and current panel members invited to reapply.

Applicants should have:

  • National mediator accreditation under the National Mediator Accreditation System (NMAS) by a Recognised Mediator Accreditation Body (RMAB);
  • Relevant experience;
  • Indicated relevant jurisdictional capability and knowledge;
  • Agreed to comply / demonstrated compliance with the administrative requirements of the VSBC; and
  • Confirmed their ability to undertake mediation appointments if offered.

VSBC Mediation Panel members will be governed by the VSBC Policy for Appointment of Mediators.

Fees paid to VSBC Mediation Panel Members are outlined in the VSBC Mediation Panel Fee Policy.

Last year the VSBC held over 600 commercial dispute mediations.

Panel Members will be offered a minimum of three VSBC mediations per year. Offers of mediations declined by Panel Members count towards the minimum number.

Application and Selection Process

The application form is to be completed by all persons wishing to be appointed to the VSBC Mediation Panel. An up to date resume must accompany all applications.

All information and supporting documentation requested in the application form is mandatory and will form part of the selection process to determine the most suitable applicants to provide high quality mediation assistance to Victorian small businesses in commercial disputes.

To be appointed to the VSBC Mediation Panel, an Applicant must be accredited under the National Mediation Accreditation System (NMAS) by a Recognised Mediation Accreditation Body (RMAB). Applicant’s details must be listed on the Mediation Standards Board (MBS) website under the Register of Nationally Accredited Mediators or else their application may be rejected. The selection process will involve consideration of each Applicant’s declared skills and experience against the needs of the VSBC’s dispute resolution functions.

Incomplete and/or late applications will not be considered.

All applications received electronically will be acknowledged by email and treated in confidence.  All Applicants will be notified of the result of their application by email.

Shortlisted Applicants may be required to attend an interview.

Once the application process is completed and the panel is fully appointed, the process will be closed.

Panel members are required to notify the VSBC of any change in their status that may affect their qualifications to be a member of the panel.

The appointment, reappointment, and removal of panel members remains within the sole and absolute discretion of the VSBC.

To continually achieve the goal of providing high quality mediation services, the VSBC reserves the right to change panel membership appointment and reappointment requirements as and when it deems necessary.

Application is a competitive process. No correspondence or discussion will be entered into with persons who are not successful in their application to be appointed a member of the VSBC Mediation Panel.

You can assume that we have received applications from vastly more Applicants than we needed to appoint.
